POPIA NOTICE

1. ABOUT THIS NOTICE

This notice explains your rights under the Protection of Personal Information Act 4 of 2013 ("POPIA") when you use this website. It should be read with our Privacy Policy.

This website is operated by OPULENCE FLOW (PTY) LTD ("Opulence Flow") on behalf of the dental practice featured on this website (the "Practice"). The Practice is the responsible party for your personal information. Opulence Flow is its operator.

2. HOW WE PROTECT YOUR INFORMATION

Your information is processed in line with the eight conditions for lawful processing in POPIA: accountability, processing limitation, purpose specification, further processing limitation, information quality, openness, security safeguards and data subject participation. In practice, this means:

• only your name, surname, email address and phone number are collected, together with your booking details;
• your information is used only to arrange your assessment, follow up on your enquiry and, if you agree, send you offers from the Practice;
• your information is never sold;
• you can opt out of messages at any time; and
• your information is kept secure and deleted from our systems when it is no longer needed.

3. YOUR RIGHTS

You have the right to:

(a) be told that your personal information is being collected, and by whom;

(b) be told if your personal information has been accessed or acquired by an unauthorised person;

(c) find out whether personal information about you is held, and request a copy of it;

(d) request the correction, destruction or deletion of your personal information;

(e) object, on reasonable grounds, to the processing of your personal information;

(f) object at any time to the use of your personal information for direct marketing;

(g) withdraw your consent at any time; and

(h) lodge a complaint with the Information Regulator.

4. HOW TO MAKE A REQUEST

Contact the Practice directly, or email jose@opulenceflow.com with the subject line "POPIA Request", and include:

• your full name and the phone number or email address you used to book;
• the name of the Practice you booked with;
• what you would like us to do (for example, send you a copy of your information, correct it, delete it, or stop messages); and
• if you are acting for someone else (such as your child), confirmation that you are their parent, guardian or authorised representative.

You may also use the prescribed forms under the POPIA Regulations: Form 1 (objection to processing) and Form 2 (request for correction or deletion), available on the Information Regulator's website.

We may need to confirm your identity before acting on a request, to protect your information.

5. HOW REQUESTS ARE HANDLED

If your request is about information held in our systems, we will act on it with the Practice's authorisation. If it is about the Practice's patient records, we will pass it to the Practice and help it respond. You will receive a response within a reasonable time, and in any event within 30 days of a complete request. Requests to correct, delete, object or stop messages are free.

To stop messages immediately, reply STOP to any SMS or click "unsubscribe" in any email.

6. SECURITY BREACHES

If there are reasonable grounds to believe that your personal information has been accessed or acquired by an unauthorised person, Opulence Flow will notify the Practice immediately, and you and the Information Regulator will be notified as required by section 22 of POPIA.
